Legal Position: Minors Cannot Enter Contracts

Under the Indian Contract Act, 1872, a contract with a minor is void ab initio. Selling gold is a contract - therefore a person under 18 cannot legally sell gold on their own. The natural guardian (parent or legal guardian) must conduct the sale on the minor's behalf. The gold buyer records the guardian's Aadhaar - not the minor's.


Process: Selling Gold Owned by a Minor

  1. Natural guardian (parent) brings the minor's gold to the branch
  2. Guardian presents their own Aadhaar card
  3. Guardian presents PAN if sale > ₹2,00,000
  4. Minor's birth certificate or school ID may be asked to confirm relationship
  5. Receipt is issued in the guardian's name as legal representative
  6. Proceeds belong to the minor - guardian holds them in trust
  7. Capital gain is reported in the guardian's ITR (clubbed with their income)


Tax Treatment: Minor Gold Sale

Under Section 64(1A) of the Income Tax Act, a minor's income is clubbed with the parent with higher income. This applies to capital gains from selling the minor's gold:
• Capital gain added to the higher-earning parent's taxable income
• Parent may claim ₹1,500/minor/year exemption
• Holding period uses the original gift date


When a Minor Turns 18

At 18, they can independently sell their gold. They will need their own Aadhaar and PAN (if sale > ₹2L). The transaction proceeds like any adult seller's.
